Kathmandu – Thakur Gaire, a Member of Parliament (MP) from the ruling party CPN-UML, has demanded that Former King Gyanendra Shah and Dr. Phanindra Raj Pathak, the government’s spokesperson, face disciplinary action.

Thakur Gaire Raises Concern Over Condolence Message

According to Gaire, Dr. Phanindra Raj Pathak, in his role as the government’s spokesperson, issued a condolence message on Saturday. The message, written in Shah’s name, referred to him as “His Majesty Maharajadhiraj Gyanendra Veer Vikram Shahdev,” which Gaire pointed out as unconstitutional.

Condolence Statement Sparks Legal Questions

Gaire addressed the issue during a speech in the House of Representatives on Sunday, questioning how such a statement could be issued under the current democratic republican system. He emphasized that such language is in violation of Nepal’s constitution, which no longer recognizes the monarchy in any official capacity.

“The statement from Dr. Phanindra Raj Pathak, published under the title ‘Condolences from His Majesty Maharajadhiraj Gyanendra Veer Vikram Shahdev,’ is a direct contradiction to the constitution,” Gaire said. “In our federal democratic republic, where does the title ‘Maharajadhiraj Gyanendra Veer Vikram Shahdev’ exist?”

Call for Disciplinary Action Against Gyanendra Shah and Dr. Pathak

Gaire stressed that both the former king and the spokesperson must be held accountable for disrespecting the constitution and undermining the country’s democratic values. He demanded that the government take immediate legal action against them.

“By issuing such a statement, they are mocking the supremacy of the constitution, the supremacy of the parliament, and the rule of law,” Gaire added.

Legal and Constitutional Concerns Raised

Gaire’s statements highlight the legal implications of such actions, questioning whether it is acceptable for anyone to undermine the constitution and the democratic governance structure of Nepal.

He concluded by urging the parliament to bring both Gyanendra Shah and Dr. Phanindra Raj Pathak under legal scrutiny.
